When working with your estate planning attorney, they may recommend you have a will, power of attorney, durable power of attorney, health care directive, and if a living trust is needed, to have your assets titled as Transfer on Death (TOD), Paid on Death (POD), or Beneficiary Deed. For retirement accounts, you need to have Primary and Contingent Beneficiaries listed. These steps will help keep your estate out of probate.
